What is a class action lawsuit? And, what is the Belviq lawsuit? And, how do you know if you qualify to be included in this lawsuit? 

Let’s start this discussion by asking the following two questions before we look in detail at what a class action lawsuit is and how to be included.

  • And, if so, have you been diagnosed with cancer?

Now that we have asked the two salient questions that are relevant to this content, let’s look at what a class action lawsuit is. Secondly, we’ll look at the specifics of the Belviq lawsuit. 

What is a class action lawsuit? 

Wikipedia.com defines a class action lawsuit as a “type of lawsuit where one of the parties is a group of people who were represented collectively by a member of that group.”  

Thus, in our scenario, the group of people includes everyone who has been diagnosed with cancer and who has taken the weight loss product, Belviq. 

At this juncture, it is interesting to note that the class action lawsuit is a predominantly American phenomenon. It originated in the USA, although countries like Canada have included this lawsuit type as part of its civil law in recent times.

What is Belviq? 

Essentially, Belviq is a commercial weight-loss supplement that was recalled by the United States Food and Drug Administration (FDA). The reason being that it has been associated with the increased risk of contracting certain cancers like pancreatic, colon, and lung cancer. At the time of writing, researchers are investigating whether these products are also responsible for the development of other cancer types like brain and breast cancer.

The raison d’etre behind this announcement from the FDA is that ongoing research found that both Belviq and Belviq XR has been associated with the elevated risk of developing certain cancers. Succinctly stated, researchers have been studying the brand’s safety. And, they have found the disturbing trend, as highlighted above, that people who have taken Belviq in the past have also developed cancer. 

What is the Belviq lawsuit? 

Based on all of this research and the subsequent withdrawal from the US market, a class action lawsuit has been instituted against the Tokyo-based drug company, Eisai Inc., that manufactured and supplied Belviq for sale to the general US population.  

As an aside, the manufacturer, Eisai Inc., has announced that it has voluntarily withdrawn Belviq from the United States’ market from the beginning of February 2020. This is based on the “completed analysis of data from the CAMELLIA-TIMI 61 trial.”

It is perhaps interesting to note that the Eisai Inc. states on their Belviq site that the FDA approved the product based on the requirement to “perform a long-term trial evaluating the cardiovascular effects associated with the use of the drug.” 

Final thoughts

However, the product has been withdrawn and a class action lawsuit instated based on its link to the risk of developing cancer. Be that as it may, the product has been removed from the US market. And, if you have used the product and have subsequently diagnosed with cancer, it is vital to make sure that you are part of this class action lawsuit.
